ALI AL QARADAGHI: AL ISLAM DEEN AL RAHMAH

AL ISLAM DEEN AL RAHMAH

Sheikh Dr Ali  al Qaradaghi  Setiausaha Agong Kesatuan Ulama’ Sedunia

Rasulullah s.a.w bersabda

Abu Zar al-Ghifari r.a. pernah memanggil Bilal bin Rabah r.a.

Dimana kemanusiaan?

Dimanakah suara hati Ummah Islamiyah dan Ummah Insaniyah?

Dimanakah Pertubuhan Bangsa-Bangsa Bersatu?

Dimanakah Liga Arab?

Dimanakah OIC?

DR SIDDIQ FADZIL: BANGUNKAN KECERDASAN BERFIKIR UMAT

Ketika sambutan alaf baru milenium 2000, Rendra mengatakan bahawa Indonesia belum merdeka. Padahal semua orang tahu Indonesia telah mengisytihar kemerdekaannya tanggal 1945. Mengapa dia berkata begitu?

Al Qur’an ditafsirkan dengan panduan dan penjelasan al Hadith Rasulullah s.a.w.

SEJARAH

Begitulah pentingnya pengetahuan tentang sejarah kita, sejarah gerakan yang mesti dihargai. Di dalam dunia bisnes, sejarah mempunyai tempat yang penting – how can you know where you are going if you do not know where you have been?

Dakwah kita bukan hanya berceramah sahaja.

In uridu illal islaha mastatu`tu - Aku tidak bermaksud kecuali (mendatangkan) islah selama aku masih berkesanggupan (Hud:88).

Anwar Ibrahim seorang manusia luar biasa. Ketangkasan politiknya tidaklah kita ingin bicarakan di sini. Keintelektualannya amat menyerlah. Sewaktu dia menjadi Menteri Pendidikan, dia telah mengarahkan  semua Naib-Naib Canselor membaca laporan tentang kemerosotan pengajian tinggi di Amerika Syarikat, begitu dia prihatin dengan tahap intelektualisme di universiti-universiti. Saya pernah berpesan melalui tirai besi bagi menanyakan tajuk sebuah buku kerana saya hanya teringat se patah perkataan dalam tajuknya, Anwar menjawab dengan maklumat lengkap: tajuk penuh, pengarang, penerbit dan tahun penerbitan - A Nation at Risk: The Imperative for Educational Reform - A Report to the Nation and the Secretary of Education,  United States Department of Education by the National Commission on Excellence in Education, April 1983 serta dia menambah pula maklumat buku baru yang menyusuli laporan itu - A Test of Leadership -Charting the Future of U.S. Higher Education (2006).

KRITIK DIRI

Contohnya, kita lihat perbahasan tentang isu hudud. Ada yang menggesa mahu perlaksanaannya berlaku sekarang. Memang kita mempertahankan hudud tetapi sedar betapa perlunya melihat realiti dan mengikut prioriti. Kita sejak 70’an lagi telah komitted memperjuangan tatbiqul syari’ah.

Kebetulan saya baru selesai mengunyah The Quest for a Moral Compass: A Global History of Ethics yang saya segera bandingkan dengan Bertrand Russell A History of Western Philosophy,  Islamic Philosophy from Its Origin to the Present: Philosophy in the Land of Prophecy Sayyid Hossein Nasr, Orientalism Edward Said dan Tabai al-Istibdad wa-Masari al-Isti’bad (The Nature of Despotism) Abd Rahman al Kawakibi.

SAVING HUMAN LIVES

THE CLAMOUR TO EXECUTE AND TAKE LIVES

Iran executes hundreds of political detainees deemed terrorists. Saudi executes political opponents as terrorists. Bangladesh executes opposition party leaders one after the other. Egypt sentences to death their first democratically elected president and hundreds of his political supporters.

These regimes are simply uncivilised. Where developed nations rule and treasure liberty, these nations uphold fear as the key. They rule in the darkness holding their people in contempt, always expert on managing discontent by repression and masquerading their citizens’ staunch loyalties to the regime.

PRISON AND TORTURE

Thousands of prisoners have no access to anything that could even remotely be called defence counsel. Death sentences are decided and carried out without ever given a chance to obtain legal counsel.

Some countries even cane interned economic migrants under immigration laws fully knowing the root cause of abject poverty and deprivation of their home countries.

In the name of homeland security and the battle against terror, extrajudicial methods and torture were covertly outsourced by the West to these client despotic regimes. Suspects were kidnapped and rendered by US and Western intelligence agencies to these countries hidden under the radar. These regimes specialise in the macabre and brutally extracted almost useless confessions and “dross” information from helpless detainees.

Faisal Mostafa, a UK dual national, was rendered to the TFI Dhaka and tortured.  He was beaten and subjected to electric shocks.  He was blindfolded and strapped to a chair while a drill was slowly driven into his right shoulder and hip.

An unfortunate detainee once recalled a deep dungeon somewhere in Jordan where he was shocked to find what looked like Jinn (spirits) being shackled to the walls. They were in fact old prisoners who had been kept there for years to be forgotten. The gruesome relic of the dark ages were still much alive inside the darkest holes of Jordan.

Shivers would run through people’s spines at the mention of Guantanamo, Khiam, Abu Ghraib, Tora, Abu Za’abal, Abu Salim, Tadmur, Evin, TFI Dhaka, 1391 (Israel) and al Ha’ir which are rated as some of the most notorious prisons on earth for political prisoners.

Inside police stations and prisons, torture is rife, and the number of deaths in custody is rising. Intentionally causing hurt and murder becomes mundane and insanely amusing to those in charge.

The regimes continues to substantially wield so much power and coercion to rule, even those countries without the rich oil and gas resources. They have the Mukhabarat or Mabahith (Secret Police). Being sadistic, described as a snake pit, its very name is synonymous with a heathen, an incarnation of evil that the Arab streets are familiar with.

They do not make any distinction between reformists or terrorists, political opposition or criminals.

Amnesty International and others report on primary instruments of abuse of political prisoners and for the obtaining of forced “confessions”. Methods of torture and ill-treatment suffered by detainees in places of detention included falaqa —whereby the soles of the victims’ feet are repeatedly beaten with a stick, cables, plastic pipes, ropes or whips  and shabeh (phantom), whereby the victim is suspended for up to several hours by his handcuffed wrists, and then beaten.

These practices had even spread into the prison system, where prison guards indulge in flogging defenceless prisoners with knotted electric cables, beating them with hoses and truncheons or kick them with them with fists or boots.

Prison guards torture inmates with near impunity because prosecutors and judges do too little to pursue cases. Prison conditions remain poor, especially health, food, and visitation provisions.

Islamists accused or convicted of crimes against national security (Tanzimat) face greater abuse than ordinary prisoners.

People have disappeared for over a decade, and when families tried protesting, many were forced to remain silent. There is harsh repression of any form of protest or are intimidated even when inquiring the  whereabouts of their loved ones in prison.

The public concern and assurances at the highest levels of leadership has not produced any changes or lasting effects on the ground. Prisons routinely torture or ill-treat inmates for perceived infractions of prison rules or for requests, such as access to doctors, the telephone, or visitation, but also in retaliation for complaints.

The world may never know the true extent of how many people perished in underground dungeons, how many were incarcerated for long periods, and the numbers who took the brunt of its sadism. When will be the day when investigators uncover these dungeons and freely expose the nasty barbarism sanctioned by regimes considered allies of the liberal West?

These are the dungeons with terrible memories and dreadful grievances which spawn militant extremists and outfits like ISIS.

STAYING POWER OF THE CORRUPT

Some say the factors that still sustain these decrepit regimes are oil, regional influence, arms and economic deals and close alliance with the West since the Cold War era. They have become untouchable unless and until they have lost their expediency as happened to poor Saddam and Gaddafi.

This cover allows regime authorities to act with great impunity, shrugging off most criticisms that do come their way – not only in prison practices, but seeping into how corruptly they handle other sectors such as public service, financial, social and economic issues.

In an interview with a Saudi ambassador to the US, he responded to the issue of financial corruption by saying:

There are so many countries in the Third World that have oil that are still 30 years behind. ... What I'm trying to tell you is, so what? We did not invent corruption, nor did those dissidents, who are so genius, discover it. This happened since Adam and Eve. ... I mean, this is human nature. But we are not as bad as you think.”

Every human has two faces, one, which is saintly and the other, which is dangerous. Situations and circumstances in life highlight one of the two characters of the human. We are social animals where any indecent act can cause discomfort to another. We need to seek and to be governed by the higher ideals of human dignity, honour, ethics and justice in order for sanity and humanity to prevail.

ISLAM AND THE SANCTITY OF LIFE

As Tariq Ramadan points out, in resigning ourselves to having a superficial relationship to the scriptural sources, we betray the message of justice of Islam. Foremost and primordial in the objectives of Shariah (maqasid) is the protection of human life and integrity (al nafs) and the promotion of justice.

It is our faithfulness to the message of Islam that leads us to recognize that it impossible to remain silent in the face of unjust applications of our religious references. We need assurance that people would be protected from repressive and unjust treatment. It is imperative to promote equality before the law and justice among humans. Muslim conscience the world over should not remain untouched.

The ulamâ’, as guarantors of a deep reading of the texts, the guardians of fidelity to the objectives of justice and equality and of the critical analysis of conditions and social contexts, should contribute to provide real solutions to the daily injustices.

The crises of closed and repressive political systems, religious authorities upholding contradictory juristic positions and unknowledgeable populations cannot legitimize our silence. We need to denounce the failures and the betrayals being carried out and fight for the required conditions in terms of political systems and legislation ensuring freedom of expression, equality before the law, public education, eradication of poverty and social inclusion. The education of Muslim populations should go beyond the mirage of the formalism and appearances.

Societies will never reform themselves by repressive measures and punishment but more so by the engagement to establish civil society and the respect of popular will as well as a just legislation guaranteeing the equality before the law. We have to regain our conscience, our integrity, our liberty and our rights.

Note:

Convention against Torture (CAT) defines torture as

any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him for an act he or a third person has committed or is suspected of having committed, or intimidating or coercing him or a third person, or for any reason based on discrimination of any kind, when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity.[UNHCHR]

Muslim democrats must lead the ummah in a turbulent world – Anwar Ibrahim

More than three years ago, in March 2012, I was in Dubai at a conference presenting the changing political landscape in the Muslim world when the idea of this forum  took shape.
When I used that phrase – changing political landscape, back then, it indeed reflected the turbulent times we were in. However, now with the benefit of hindsight, it did not anticipate the pace of the change, nor its intensity and ramifications.
The Arab Spring was still unfolding with Tunisia blazing the democracy trail, after successfully deposing Ben Ali, just 13 months before that.
But hardly a year later, Bashar al-Assad warned protesters of consequences of “working with foreign elements to undermine his regime.”

Soon after, the first of a series of murderous attacks by the Assad regime on its own people unfolded in the city of Homs.
Two weeks before I delivered that keynote address in Dubai, Ali Abdullah Saleh stepped down. Two months later, Mohammed Morsi won the first round of the presidential elections in Egypt and the day after, Assad ordered another round of massacre in Houla.
On June 24, 2012, the election commission officially announced that Morsi had won the presidential runoff. It was a narrow margin of 51.7% of the vote versus 48.3% for the contender.
By July, the international world finally realised that a full blown civil war in Syria was underway. Over 200,000 Syrian refugees had fled the country.
On 9/11 that year, the American diplomatic mission at Benghazi, in Libya, was attacked killing US ambassador Christopher Stevens.
Sometime in November, Morsi changed the state constitution to empower the president to “protect” the nation and to legislate without judicial oversight.
Eight months later, he was deposed in a military coup d’état.
In the early part of last year, Isis emerged as the “Kraken” seemingly out of nowhere to capitalise on the conflict in Syria and Iraq, the instability in the Middle East and the power vacuum created by the Sunni/Shia strife in the region. The rest, as they say, is history.
Lessons of history
Indeed, I have taken some time to recount these events because I believe in the powerful lessons of history – if we have the humility and the conviction to learn from them.
T.S. Eliot tells us that history can be freedom but then immediately reminds us that history can also be servitude. That, I suppose, is a question of which side of history we choose to be on.
Yes, it is true. Today, Isis is making headlines committing acts of terror, violence and barbarism not just within the Middle East but also in Europe and elsewhere.
Together with al-Shabab, Boko Haram, al-Qaeda, and other terrorist organisations, they are vying for media attention and what they believe to be the adulation and admiration of young minds. We know on which side of history they will be remembered for.
I might speak from a prison cell in Malaysia, having been unjustly denied of my freedom, but that does not present an obstacle to the deep sadness and outrage anyone must feel upon hearing of such heinous and despicable acts – most recently in seven simultaneous attacks in Paris.
These despicable acts of savage and wanton killing of innocent civilians including women and young persons deserve our unreserved condemnation.
We must join hands with all like-minded forces, eschewing all parochial boundaries of race and religion, in one resolute message – that such premeditated and cruel killing is simply not acceptable.
Today, we are on the cusp of that wave of a sea change by which future generations will judge us. The forum for Muslim democrats will be tested here.
Did the rest of the Muslim world just fold its arms in resignation as the newly minted democracies and newly liberated societies in Egypt, Libya, in Iraq crumbled under the weight of the machinations of the deep state?
It appears that the Hegelian cycle of history does ring true. Monolithic regimes built on totalitarian foundations and dictatorial use of power will not give up their culture of repression, oppression and violence even in the face of widespread protests of the people for change.
They may cave in for a while. But without the full conviction of the people and the establishment of democratic institutions, they will return with a vengeance.
Spring may revert to winter because there are always counter-revolutionary forces at work to turn the clock back and restore the power and glory enjoyed for so long.
The brutal mayhem and bloody reprisals unleashed on the people will serve as chilling reminders of the desperation and savagery of tyrants and autocrats who refuse to give up power.
Muslim democrats must not allow the deep state or the terrorists to continue hijacking the course of history. We must chart a new course. In this new narrative, there will be zero tolerance for them.
We must make it clear that the actions of these killers can never be jihad. This is corruption of Islam of the most vulgar and savage kind. They don the cloak of religiosity and claim they are doing this for Islam and the umma but what they really seek is worldly gain and political power.
A such, we must reiterate our condemnation on the dastardly/barbarous acts of the fanatical few – and Isis as the war menace to a civilised world.
Our resolve and struggle for reform, democracy and justice are unequivocal and unabated. It’s a bold intiative – to determine the narrative; that freedom and justice; that democracy and the rule of law are rightfully the Muslim agenda.
Imperatives for the Muslim ummah
In this ever more turbulent world, what we need is to keep our focus on what is best for the ummah.
We must be clear on the fundamentals of governance, characteristics in determining the legitimacy of a regime. The main predicament or malaise of the ummah is the inability to participate in the process of determining who represents them. This is at the core of the problem.
So, we must strive for a humane economy and a clean and caring government. We need to strike a balance between free enterprise and the demands of social justice.
We need constitutional guarantees for our fundamental liberties, good governance and an independent judiciary.
How are we treating our women and children, the old and the infirm? We demand rights for Muslims in non-Muslim majority countries but what is our record and position when it comes to protecting the rights of minorities in Muslim countries?
We must strive to stamp out bigotry and intolerance within ourselves. Islamophobia begins at home. Sunni Muslims fear Shia Muslims and Shia Muslims fear Sunni Muslims. And within the different denominations, sub-denominations harbour mutual suspicion.
We need to go through a rebirth. This implies reform and renewal. We need to boldly go on the path where the Maqasid Shariah will guide us.
The demands of islah (reform) would also warrant that interpretation of Islamic law be re-examined not just in the light of the historical experience of Muslims under colonial rule but taking into account the maqasid. There is a need to reemphasise the true, peaceful and pluralistic nature of Islam.
The forum must endeavour to encourage Muslim intellectuals and masses to return to the primacy of the Islamic message of freedom and rahmatan lil alamin (blessings to the worlds).
This is also in line with a very healthy growing trend among Muslim scholars to go deeper into the area of civilisational dialogue. The importance of interfaith programmes cannot be overemphasised.
Economic empowerment is essential. Among the two billion plus Muslims, more than half are living below the poverty line. This kind of economic marginalisation breeds devastating socio-economic consequences.
The very idea of social justice is at stake. Where is the social justice enjoined by the Quran and the Sunnah? What has become of the Islamic imperatives on health care, education, housing and employment?
The outrageous inequities that plague the Muslim world will persist and get even worse if there is no collective and concerted effort.
The Muslim nations that are better off must lead this venture armed with a clear and firm resolve to those who are not so fortunate.
We cannot be mere bystanders
The greatest tragedy is that other Muslim nations tend to be mere bystanders in this theatre of mayhem and killing.
And because of this, the stark reality is that the future of these nations lies not in the hands of the Arab and Muslim world but in the United States of America and Europe.
In spite of the immense wealth in oil and other resources, they choose to hibernate in pathetic indifference while some are themselves in utter disarray.
Is it because it is not happening to us directly that we tell ourselves that it doesn’t really concern us?
Martin Luther King, Jr. reminds us that “Injustice anywhere is a threat to justice everywhere. We are caught in an inescapable network of mutuality, tied in a single garment of destiny. Whatever affects one directly, affects all indirectly.”
What we need is less looking at others and more at ourselves.
Ask one fundamental question: Why do Muslim refugees prefer to seek asylum in the European countries rather than in the Middle East or in other Muslim countries elsewhere?
What does it say about the state of the Muslim world when the most trampled, most disadvantaged and the least fortunate of its umma, prefer to seek shelter in countries such as Germany, Sweden, Hungary, and Turkey?
We, therefore, need to look into our moral compass and ask where the arrow is pointing.
The issue of legitimacy in government is an overarching problem in the Muslim world. Despite decades of independence, we are still grappling with the fundamental questions of democracy, the rule of law, justice and human dignity. The powers that be are too preoccupied with staying in power to bother about political legitimacy.
Forging ahead with the Maqasid
Based on the Maqasid Shariah, there are sufficient imperatives for Muslim leaders to get on with the task of establishing the institutions of governance for justice, democracy and human rights. That is the way forward for the resurgence of the ummah.
Social justice must be a priority and Muslim societies being among the poorest in the world, must address poverty. Poverty is to be eliminated and education be made a birth right.
To talk of an Islamic resurgence without freedom of speech, or freedom from arbitrary arrest, is pointless. To my mind, Islamic resurgence is about ensuring the rule of law, clean government, social justice, and cultural empowerment where women are not treated as second-class citizens or regarded as mere chattels and minorities are not marginalised.
It is a trying period ahead for the Muslim world and the road to recovery and strength is long and winding.
The greatest challenges facing the ummah is not the West or Europe, but from within. Tajdid (renewal) and islah must emanate from within ourselves.
Conclusion
A revolution may happen overnight but the transition to democracy requires sustained efforts, collective will and steely resolution to let it take its course. Or else, the reversion may lead to situation even worse than the one it had attempted to replace.
In this part of the world, we can see that the experience of Indonesia shows that the first cycle of transformation set in motion. Civil liberties are now guaranteed and basic institutions of civil society flourish.
Elections are generally free and fair as well as transparent. There are institutions in place to ensure the existence of an effective check and balance against executive powers, the protection of fundamental liberties, the rule of law and an independent judiciary.
And following a free and democratic elections, the issue of democratic accountability, inequality, quality of education, and the move to address endemic corruption are allowed to effectively surface.
Such is our hope and remain future challenges for Indonesia, Turkey, even Malaysia. Muslim leaders certainly should not be known for amassing personal wealth but for propagating rahmatan lil alamin.
Finally, allow me to thank all friends for their sense of comradeship, sympathy and support in supporting this vision during my forced hiatus. Insha Allah, I shall soon return.

Let me part with a quote from a 17th century English poet Richard Lovelace, who, too, had the honour of going in and out of prison for his beliefs:
Stone walls do not a prison make,
Nor iron bars a cage;
Minds innocent and quiet take
That for an hermitage;
If I have freedom in my love
And in my soul am free,
Angels alone, that soar above,
Enjoy such liberty.
I end with a reminder that continued repression by ruthless dictators and autocrats, are incubators for fanatics.
In the absence of hope of reform or peaceful regime change, their only option is to promise heaven by blowing themselves.
The barbarous few terrorists aim to create fear and perhaps to provoke similar retaliatory actions of hate. It is imperative we ensure that they fail to do so.
We must remember that they do not speak for or represent the overwhelming majority of peace-loving human beings. The barbarous few cannot be allowed to hijack Islam.
Democrats worldwide, it is time to unite.

They came from the Dungeons of Tyrants. The Dungeons are still there.

According to someone belonging to an earlier generation of radical jihadists who now resides in a maximum security prison in the US and views shared by others who are critical of present policies pursued, there has to be a different narrative from the “them or us” zero sum game of war.

ISIS are not like the jihadists recruited from all over to fight as it was in Afghanistan, Bosnia and Chechnya. They are the Sunni Muslims that have lived through 25 years of wars, torture, and rapes. They are the Iraqi that have suffered from unjust wars started by the US. They are Syrian people tormented, barrelled bombed and massacred by Bashar Assad.

When the US pulled out of Iraq in 2010, the Shia led by Maliki’s government started killing and torturing the Sunni day and night.

The US and the world’s response was that it was an internal problem. It seemed that they are trying to spin it like ISIS are aliens from another planet. Arab and Muslims know ISIS are the native people of Iraq and Syria. Some were incarcerated in American prisons in Iraq during the occupation for years.  And nothing nurtured the growth of ISIS as much as the marginalization and humiliation of Iraq’s Sunni community in the gloomy dungeons of Abu Ghraib and Camp Bucca. Guantanamo is still the living glaring grotesque image and lingering dread of human degradation of Muslims rendered and designated arbitrarily as enemy combatants.

They had tribal support which are very big families in Iraq. The Iraqi people are the most stubborn of the Muslim world. They will not accept occupation or dishonour.

The recruits for ISIS are Muslims from all over the world that have seen an injustice of nearly a century, seeing only defeat, powerlessness, hopelessness, indignation and humiliation. They want to help and be able to do something. They apparently see an organization that is effective and winning battles. They want to be with their brothers and sisters in their time of need. They wish to do their part in the jihad.

Imagine the plight of Iraq and Syrian people. After a year of bombing, they see their people killed, their land and homes destroyed, children so scared that they hide all day. Bombs come from the sky and they are unable to stop it. US Air Force Secretary Deborah Lee James speaking about replenishing munition stocks said, "We're in the business of killing terrorists, and business is good." This is business to them. But it is human life. Human life has the right to exist.

So, the question should be who is the first to be blamed? We have to tell both sides of the story.

Arabs are not radicalizing themselves but action by US and its allies including its rival Russia is radicalizing them. People see the pictures, days and nights of bombs, the refugees, and the millions running away from war.

Arabs want to live the way they want to live. For a century they have suffered under dictators and tyrants strongly backed by the West. They want to live a decent life, that is all. The West want them to live under their law, their order, their control. But the West will not give them freedom.

They cannot live like the West. They are different from them and the only thing that keeps them just and sane is Islam.

If they have an Arab leader without Islam which is not superficial, he turns out to be  a dictator.

Out of the deepest and darkest dungeons of these despots, ISIS came and declares an Islamic State after a century of living under cruel dictators who were tolerated, encouraged, nurtured, collaborated and supported by the West.

ISIS thus came forth and the problem of Muslims got even worse.

More important than a competition for strongest terms to denounce ISIS (or insisting on calling out the Arabic acronym Da’esh because of an alleged derogatory connotation in Arabic) Europe and the US need to think about some real policy changes.

In order to solve the root of the problem, everyone has to become human again. They need to engage, to talk to one another, however bad it maybe. No person must be regarded as sub human or unter menshen nor infidel.

A retired veteran jihadi made this plea, “We have to let the people decide what they want. We need to leave them alone. We cannot go on fighting and killing for the rest of our limited lives.”
